Will app need to be published in App Store under the DHHS/CDC Developer Account Name?
Hello,
In Rule #5 (Intellectual Property Rights) it states that the DHHS and CDC have "the right, through an appropriate license agreement, to use and distribute" the app. In the case of an iPhone app, does that mean the DHHS/CDC will need to have the right to publish the app in the App Store under their Developer Account Name? Or can the app still be published under our own developer account and linked to in the DHHS/CDC's promotional items/website/etc to fulfill their rights to "distribute" the app?

Rule #5:
Intellectual Property Rights: All tools and games submitted to the CDC Flu App Challenge remain the intellectual property of the individuals or organizations that developed them, though the DHHS and CDC will retain the right, through an appropriate license agreement, to use and distribute all applications to the public free of charge for one year after the announcement of winners.

The applications you develop may be published under your name in the Apple App Store. DHHS and CDC retain the right to ensure that the application be available for free for up to one year. The terms of such an agreement would be negotiated at a later point, but could include simply no charge for one year, or a ‘free’ version and a ‘premium’ version for which you could charge or other such arrangements.
