Hi Carrey -
Yes, the standard disclaimer is is mandatory for applications deployed on non-CDC information systems. This rule, as well as the disclaimer text, is stated in rule number twelve on the rules tab of the challenge. Applicantions that do not adhere to this requirement, are not eligable to compete for prizes in the contest.
Below is the standard disclaimer informaiton and text as it appears in the rules. Thanks for your question, and let me know if you have any other concerns.
Standard Disclaimer: The following disclaimer is mandatory for applications deployed on non-CDC information systems. This standard disclaimer shall be incorporated into the software in such a way that individuals must read and accept its conditions before initial use (NOTE: The standard disclaimer must appear in all capital letters):
THE MATERIAL EMBODIED IN THIS SOFTWARE IS PROVIDED TO YOU "AS-IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR OTHERWISE, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE CENTERS FOR DISEASE CONTROL AND PREVENTION (CDC) OR THE UNITED STATES (U.S.) GOVERNMENT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, LOSS OF PROFIT, LOSS OF USE, SAVINGS OR REVENUE, OR THE CLAIMS OF THIRD PARTIES, WHETHER OR NOT CDC OR THE U.S. GOVERNMENT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE POSSESSION, USE OR PERFORMANCE OF THIS SOFTWARE.
Thanks for this. We had asked the question previously and the answer from the previous moderator was that this was only strongly preferred (see below). This would mean that it's not required. Our assumption is that this would required if this app if fact went live in connection with CDC. Since almost all apps, do not have this disclaimer, can you confirm whether they are disqualified? And might we be able to add it at this point?
It is strongly preferred to already have the language included in your app submission. Thanks!
Hi Again -
Apps will not be disqualified, or scored lower if they do not present the disclaimer, however winning Apps will be required to incldue the disclaimer if their application is deployed on non-CDC information systems.
Is it passed the judging phase so that those of us that missed the disclaimer can update our apps? Even if we didn't win and it won't affect our scores, I'm sure all of us that missed the disclaimer would like to fix our apps to be in compliance.
